Acceptance of Terms

These Terms of Service govern your use of the website tinydeskai.studio and the video generation service offered on it (together, the "service"), operated by Tiny Desk AI ("we", "us"). They apply to every visitor and every account. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.

Description of Service

The service lets you upload 1 to 5 photos and generate a short AI parody video for the Outstanding Tiny Desk AI trend: a re-creation of the closing "Outstanding" moment of Charlie Wilson's 2023 NPR Tiny Desk Concert, with the people in the photos as the band. Videos are generated by third-party AI providers on our behalf (see "AI Models We Use" below). We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

The service is an independent parody tool, not affiliated with NPR, Tiny Desk, Charlie Wilson or The Gap Band, and not endorsed by them or by any music rights holder. Their names are used only to describe the performance the trend is about. We do not offer the original concert footage for download; the full performance is shown on our site only as an embed of NPR Music's official YouTube video.

Our Commitment to Compliance

We take consent, privacy and intellectual property seriously, and we enforce these rules with zero tolerance:

• Only photos you have the right to use. Every photo must show you, or someone who has given you permission to use their photo for this purpose. You must confirm this before every generation.
• Immediate account termination. If we confirm that an account has uploaded someone's photo without permission, shown a minor or a public figure, or otherwise infringed anyone's rights, we remove the content and permanently terminate the account immediately, without a refund of credits. Repeat or evasive accounts are blocked as well.
• Fast removal. We review every report and rights-holder notice by hand within 72 hours, and we take content offline while we review serious reports.
• Cooperation. We cooperate with rights holders, platforms and law enforcement, and report illegal content to the authorities where required.

Eligibility and Accounts

You must be at least 18 years old to use the service. You can generate videos with an account or, where offered, as a guest. A guest purchase creates an anonymous guest account tied to your browser, and we email your video to the address you enter at checkout; you are responsible for entering an email you can access. When you sign in with that email (with a sign-in link from Find my videos, or with Google), the guest's videos, credits and orders move to your account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

Your Uploads

You may only upload photos that:

• show yourself, or a person who has given you permission to use their photo for this purpose;
• you have the right to use;
• do not show anyone under 18; and
• do not show a public figure, such as a celebrity, athlete, coach or politician, including Charlie Wilson or any other musician.

Uploading a photo of another person without their permission is not allowed.

By uploading a photo, you confirm that these conditions are met. You are responsible for the photos you upload and the videos you generate from them. Uploading a photo you are not allowed to use is a serious breach of these terms and leads to immediate, permanent termination of your account (see "Our Commitment to Compliance").

You grant us a limited license to store, process, and transmit your photos and generated videos as needed to provide the service, including sending photos to our AI providers for processing. You can delete a finished video, its share link and the photos you uploaded for it at any time in My videos; see our Privacy Policy for what is removed.

Deepfake Prevention and Content Safety

The service is built to make one specific, recognisable joke video, not realistic footage of real people doing or saying things. These are the measures in place today:

1. Consent confirmation. Before every generation you must confirm that the photos are yours or that you have permission to use them, and that they do not show a minor or a public figure. The generate button and our server both reject requests without this confirmation.
2. One fixed template. Every video is the same concert scene. You cannot enter a prompt or change the scene, the actions, the dialogue or the sound, and there is no voice cloning or speech generation from your input. The service cannot be used to make someone appear to say something or to place them in any other scene.
3. Illustration step and provider screening. Each photo is first turned into an illustrated reference image, and only those are sent to the video model. Our AI model providers run their own safety checks on real-person and sensitive content. When a provider blocks a request, the generation fails and the credits used for it are returned to your account automatically.
4. Prohibited uses. You may not use the service, or videos made with it, to:
   • use another person's likeness without their consent;
   • impersonate anyone or deceive people about who appears in a video;
   • harass, bully, threaten or shame anyone;
   • create sexual or sexually suggestive content;
   • create political disinformation or misleading content about elections, public figures or public events;
   • commit fraud or scams; or
   • depict or target minors.
5. Reporting and removal. Every shared video page has a Report this video link, and you can also email support@tinydeskai.studio. We review reports within 72 hours and remove videos that break these terms. Accounts that break these rules are terminated without a refund of credits, and we cooperate with law enforcement where required.
6. AI-generated content. Every video made with the service is AI-generated, fictional content. It is not real footage and has no connection with NPR, Tiny Desk, Charlie Wilson or The Gap Band. When you share a video, follow the AI-content labeling rules of the platform you post on, and do not present it as real footage.

Acceptable Use

In addition to the prohibited uses above, you agree not to use the service to create, upload, or share:

• hateful, threatening, or violent content;
• content that infringes anyone's intellectual property, privacy, or publicity rights; or
• content that violates any applicable law.

You also agree not to attempt unauthorized access to our systems, interfere with the service, or use automated means to abuse it.

We may refuse, remove, or block content, and suspend or terminate accounts, that we believe violate these terms.

AI Models We Use

• Reference images: each photo is first turned into a reference illustration by Nano Banana 2 (Google's Gemini 3.1 Flash Image). We access this model through the API provider APIMart.
• Your videos: generated with Seedance 2.0, a video model developed by ByteDance, which we access through Volcengine Ark. It uses a reference video of the closing moment, with the original performers' faces hidden, as the scene and motion reference, and puts the people in your photos in as the band.
• Audio: the main MP4 carries the audio of the original "Outstanding" moment, added with the fal ffmpeg API. A version without music is also provided so you can add sound on the platform where you post, in line with its rules. GIFs are silent.

If we change the model used for your videos, we will update this section before the change takes effect.

Reporting Content

When to report. Report any generated video that breaks these terms, including content involving minors, a video made from your photo without your permission, impersonation, or content that infringes your rights.

How to report.

• Click Report this video on any shared video page.
• Or email support@tinydeskai.studio with the subject "Content report". Include the video link (for example, https://tinydeskai.studio/v/...) and a short description of the problem.

How we handle reports. We review each report by hand within 72 hours. When a report is confirmed, we delete the video from our storage and disable its share link, and act on the account according to the severity:

• Critical (content involving minors, sexual content of real people): content removed, account terminated, and reported to the authorities where required (for example, child sexual abuse material to NCMEC).
• High (someone's photo used without consent, a public figure's photo, impersonation, harassment, infringement of someone's rights): content removed and account permanently terminated immediately, without a refund of credits.
• Other breaches: content removed and a warning issued; a second breach leads to termination.

We keep the identity of the person making a report confidential. We record false or malicious reports and may act on them.

AI-Generated Output

Generated videos are produced by AI models and may contain errors, artifacts, or results that do not match your expectations. Results depend on the photos you upload. We do not guarantee any particular outcome. Videos with a serious defect may qualify for one free re-generation after manual review, as described in the Refund Policy.

Subject to these terms and your rights in the photos you uploaded, you may use your generated videos for personal and non-commercial purposes, such as posting on social media. You are responsible for how you use and share them, including adding any music in line with the rules of the platform you post on.

Credits, Payment, and Refunds

Generating a video uses 1 credit; every video is 720p HD. Credits are sold as one-time packs; there is no subscription. Prices are shown on our website before purchase.

Orders are processed by our online reseller and Merchant of Record, Waffo Pancake, who is the seller of record for your purchase and also handles order-related inquiries and returns. We do not receive or store your full card or bank details.

Unused credits are refundable within 7 days of purchase; credits already used to generate a video are not refundable. If a generation fails, the credit used for it is returned to your account automatically. See our Refund Policy for details.

Intellectual Property

The service, including its software and design, is owned by us and protected by intellectual property laws. These terms do not grant you any rights in the service other than the right to use it as described here.

The original concert footage, NPR Music's official video embedded on our site, the song "Outstanding" and its recording, and the names and marks of NPR, Tiny Desk, Charlie Wilson and The Gap Band are not ours. They belong to their rights holders. If you hold rights in any content used by the service, send a notice to support@tinydeskai.studio with the subject "Copyright notice", identifying the work and the content concerned. We review each notice within 72 hours and remove or mute the content concerned, including removing the original audio from new and existing videos where requested. Termination

We may suspend or terminate your access at any time if you violate these terms, and we terminate accounts immediately for the serious breaches described in "Our Commitment to Compliance". You may stop using the service at any time. Unused credits are not refunded when an account is terminated for violating these terms.

Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, to the extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

Changes to These Terms

We may update these terms. We will post the updated version on this page and change the date above. Continued use of the service after changes means you accept the updated terms.
